A police report said Mathis had consumed whiskey and taken a "sleeping aid." In field tests, Mathis had shaky balance and appeared confused. A breath test revealed Mathis was driving with a 0.052 percent blood-alcohol level, below the 0.08 percent standard at which a driver is presumed drunk.
